1. Introduction

The 'AUSCOAL Group' comprises AUSCOAL Superannuation Pty Ltd (the Trustee), AUSCOAL Superannuation Fund (AUSCOAL Super) and AUSCOAL Services Pty Ltd (AUSCOAL Services).

The AUSCOAL Group has adopted this Privacy Policy to ensure that it handles personal information about individuals responsibly. This Privacy Policy may be amended from time to time.

It's important to the AUSCOAL Group that individuals dealing with it are confident the AUSCOAL Group respects their personal information and doesn't interfere with their privacy when handling this information.

The AUSCOAL Group abides by the National Privacy Principles under the Privacy Act 1988 (Cth). More information about the way the AUSCOAL Group manages personal information can be obtained by contacting the AUSCOAL Group Privacy Officer.

2. Collecting personal information

The AUSCOAL Group collects personal information for the purposes of providing financial, superannuation, pension and other services to you. If you don't provide the required personal information or, where relevant, don't allow your employer to do so, it may not be possible to provide the service requested.

The personal information collected may be used or disclosed by the AUSCOAL Group for a secondary purpose related to the above purposes, but only if you would reasonably expect the AUSCOAL Group to use or disclose the information for this secondary purpose. However for sensitive information, the secondary purpose must be directly related to the purposes above.

The details of exactly what types of personal information we collect can be found on the forms we ask you to complete, on our website and in the questions we ask. Typically this may include your name, address, date of birth, gender, occupation, salary, tax file number, medical information, email address usage of the AUSCOAL Super website and any other required information.

AUSCOAL Super may collect health information about you to enable you to obtain death or disability insurance cover or to process your disability claim. This may be collected from you directly or from a medical practitioner in accordance with your signed authority. Information about your potential beneficiaries may also be held by AUSCOAL Super.

Also, under anti-money laundering (AML) legislation, the AUSCOAL Group must collect and verify certain information about you before payment of benefits or commencing pension payments, or arranging to provide other services covered under the AML rules.

3. Use and disclosure of personal information

In undertaking its obligations to you, the AUSCOAL Group may disclose your personal information to the organisations and people described below where appropriate. Where personal information is disclosed the AUSCOAL Group will seek to ensure the information is held, used or disclosed consistently with the National Privacy Principles and other applicable privacy laws and codes.

The AUSCOAL Group is also bound by legal obligations of confidentiality. It doesn't sell or rent out any of the information it holds on you and protects the security of that information in accordance with regulatory requirements and industry practice.

3.1    Use and disclosure by the AUSCOAL Group

The relevant organisations and people are:

  • the different entities within the AUSCOAL Group
  • organisations involved in the AUSCOAL Group’s normal business practices
  • the AUSCOAL Group’s auditors
  • government or regulatory bodies such as the Australian Taxation Office, the Australian Prudential Regulation Authority, the Australian Securities and Investments Commission and the Australian Transaction Reports and Analysis Centre
  • the AUSCOAL Group’s legal and other professional advisers, and
  • other business support providers, including document storage, printing and collating companies.


3.2    Use and disclosure by AUSCOAL Super

The relevant organisations and people are:

  • should you become a member of another superannuation fund, your personal information may be transferred to that fund
  • your employer may be provided with your personal information to facilitate provision of benefits in the ordinary course of your employment, and
  • insurance brokers and/or insurers who provide death and disability cover for you.


3.3    Use and disclosure by AUSCOAL Services (when providing advice services)

The relevant organisations and people are:

  • those involved in providing, managing or administering a product or service such as investments, superannuation, banking services, loans, tax returns, legal affairs and estate planning
  • advisers who wish to advise you of products or services and their related service providers, except where you have indicated that you don't wish for such disclosure to be made
  • other organisations to which personal information is usually disclosed are, mortgage insurance companies, guarantors, organisations involved in valuing, surveying, or registering a security property or which otherwise have an interest in such property, share transacting or broking services; trustee or custodial services and their advisers, and
  • insurance brokers and/or insurers who provide death and disability cover for you.

4.    Privacy on the internet

4.1.    Website
The AUSCOAL Group takes care to ensure that the personal information provided by you on the AUSCOAL Super website is protected.

4.2     Use of cookies
The AUSCOAL Super website may use cookies to improve its functionality. When you visit the website, details about the visit, such as time and date, pages accessed duration of visit and type of browser may be recorded. This information is collected for statistical purposes and can also identify you individually. If you don't wish to receive cookies you can change your browser settings to refuse all cookies or to notify you each time a cookie is sent to your computer and give you the choice whether to accept it.

4.3    Links to other sites
You may be able to access external websites by clicking on links provided on the AUSCOAL Super website. Those other websites aren't subject to the AUSCOAL Group’s privacy standards, policies and procedures.

5. Access to personal information

You can access your own personal information by contacting the AUSCOAL Group Privacy Officer. A fee may apply. If the information held by the AUSCOAL Group is inaccurate, incomplete or not up to date you may request the AUSCOAL Group to correct the information.

There are some circumstances in which the AUSCOAL Group is entitled to deny you access to information. These include circumstances where such information is used in confidential Trustee decisions or in a commercially sensitive decision making process, where the privacy of others may be breached if the information was accessed or where the law requires or authorises such access to be denied. The AUSCOAL Group Privacy Officer will advise if any of these circumstances apply.

6. Resolution of privacy concerns

If you're concerned about a possible interference with privacy or a breach of this Privacy Policy, you should contact the AUSCOAL Group Privacy Officer. If your concerns aren't resolved to your satisfaction, the matter can be referred to the Australian Information Commissioner on 1300 363 992.
